Privacy Agreement

1. General provisions

This privacy policy regulates the main principles and procedures of personal data collection, storage and processing in connection with the use of the Wash&Go Laundry Solutions mobile application of Dabrel BV, with registered number 63348918 and VAT number NL855197845B01 whose registered office is at Overhoeksparklaan 8, 1031KC Amsterdam, (hereinafter referred to as ‘Dabrel’, i.e., the company providing the Wash&Go Laundry Solutions mobile application).

2. The collection, processing and storage of your personal data shall be determined by and will be in line with this privacy policy, as applicable, the Law on Legal Protection of Personal Data of the Netherlands and/or any other (European) applicable legal acts (such as the General Data Protection Regulation 2016/679).

3. By adding your personal data in the Wash&Go Laundry Solutions mobile application and checking the box next to the statement "I have read and approved the Terms and Conditions for the purchase and sale of services including the Privacy Policy in the mobile application of Wash&Go Laundry Solutions and agree to abide by them and agree that my Personal Data can be collected, stored and processed as set out in the Privacy Policy”, you agree that Dabrel as controller is allowed to collect, store and process these data for purposes, measures and procedures provided in this privacy policy and the applicable legislation. To the extent your Personal Data are collected, stored and/or processed upon your consent (as lawful reason of the processing), you will have the right to withdraw your consent at any time, by sending such a request to: info@washandgolaundry.nl. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

4. Dabrel shall comply with the following main personal data processing principles:
4.1. Personal Data will be collected for specific, explicit and legitimate purposes.
4.2. Personal data will be processed in a lawfully, fairly and in a transparent manner in relation to the Seller.
4.3. Personal data shall be processed legally and if necessary for the legitimate purposes (i.e., the Personal Data will not be processed in a manner that is incompatible with those purposes); i.e., only in cases when: (a) consent is received from the data subject, i.e., when the data subject agrees to the terms of use of the Wash&Go Laundry Solutions mobile application and the Privacy Policy by checking the box next to the statement “have read and approved the Terms and Conditions for the purchase and sale of services including the Privacy Policy in the mobile application of Wash&Go Laundry Solutions and agree to abide by; and agree that my Personal Data can be collected, stored and processed as set out in the Privacy Policy” ; (b) an agreement (other than the consent as mentioned in point (a)) is concluded or executed between Dabrel and; the data subject in view of the processing of the data subject’s personal data; (c) Dabrel is obliged to process Personal Data of the data subject according to any applicable law or regulation; (d) the personal data are processed for a legitimate interests of Dabrel set forth below (point 6), and taking into account the proportionality principles in view of the processing and gathering of personal data.
4.4. The data subject’s personal data will be updated in order to ensure their accuracy.
4.5. The data subject’s personal data will not be stored longer than required for the purposes of the data processing and to comply with applicable law requirements (e.g., in view of tax or VAT obligations).
4.6. Personal data is processed only by those employees of Dabrel or the third parties, processors to whom the personal data are transferred in order to achieve one or more of the envisaged purposes as refereed to under point 6 and who are authorized to do so.
4.7. The data subject’s personal data will be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed
4.8. All information regarding the processed personal data will be treated as confidential.
4.9. The relevant authorities must and will be informed about personal data processing in accordance with applicable laws.

5. The Wash&Go Laundry Solutions mobile application can only be used by the following data subjects:
5.1. All capable natural persons over 18 years of age;
5.2. minors up to eighteen years of age, who have the consent of parents , foster parents or guardians, except in cases when they dispose of their own earnings or scholarships (i.e., ontvoogde minderjarigen);
5.3. Legal entities;
5.4. Representatives authorized by the above mentioned persons or representatives of legal entities. If minors will use the Laundry Solutions mobile application, Laundry Solutions mobile application, processing based on consent shall be lawful only if and to the extent that consent is given or authorized by the holder of parental responsibility over the child.

6. Collection, processing and storage of personal data. Dabrel respects the right to privacy of each of you, the data subject. Your personal data (i.e., name, surname, e-mail address and phone number, which makes it possible to identify you, whether direct or indirect) in view of the Wash&Go Laundry Solutions mobile application is collected and processed for the following purposes:
6.1. for the payment of goods and services offered by Dabrel and connected to the Wash&Go Laundry Solutions of Dabrel;
6.2. for the reservation of washing machines and dryers of the Wash&Go Laundry Solutions of Dabrel, and to receive notifications on the end of a cycle of the used washing machine and dryer;
6.3. to solve problems related to the presentation or delivery of goods or services connected to the Wash&Go Laundry Solutions of Dabrel;
6.4. to carry out other contractual obligations connected to the Wash&Go Laundry Solutions of Dabrel.

7. During the registration, you must provide correct personal data.

8. When collecting, processing and/or storing your personal data, Dabrel implements and uses appropriate organizational and technical means that ensure the security and protection of personal data against accidental or unlawful destruction or loss, damage alteration, disclosure, and any other unlawful processing.

9. Dabrel can use impersonal (anonymous) data, not directly or indirectly related to your person, for statistical purposes, e.g., data on the ordered goods and services. Such statistical data shall be collected and processed in a way that would not reveal the identity of the data subject or other personal data that could be used to determine a person’s identity.

10. Transfer of personal data to third parties. Dabrel shall reserve the right to transfer personal and impersonal data to third parties:
10.1. only for the implementation of purposes and in line with the principles indicated in paragraphs 4 and 6 of this privacy policy;
10.2. only according to the procedures and principles established by applicable laws.
10.3 when the processing of your personal data is carried out by a third party on behalf of Dabrel, Dabrel shall use only processors providing sufficient guarantees to implement appropriate technical and organizational measures in such a manner that processing will meet the legal requirements and ensure the protection of the rights of the data subject. Processing by a processor shall be governed by a contract or other legal act, that is binding on the processor with regard to Dabrel and that sets out the subject-matter and duration of the processing, the nature and purpose of the processing, the type of personal data and categories of data subjects and the obligations and rights of the controller.
10.4 If the processing of your personal data would take place in a third country (i.e. a country outside the European Economic Area) which does not offer an adequate level of protection, this processing shall be carried out in accordance with the requirements and appropriate safeguards under the applicable data protection legislation, such as, entering into EU standard contractual clauses. 

11. Amendment or updating of personal data. You as data subject have the right to amend and/or update your personal data by amending or updating such data at any time. Transfer of information or claims.

12. Once you as data subject agree to allow your personal data to be collected, stored and/or processed, you have the right to:
12.1. require removal of your personal data or suspension or limitation of processing of personal data;
12.2. object to the processing of your personal data. A request for a removal, withdrawal of consent or an objection under this Section 12 implies that you agree that you can no longer use the Wash&Go Laundry Solutions mobile application

13. Upon the receipt of your request in line with Section 12 of this privacy policy, Dabrel will provide you with a confirmation. Requests for personal data processing will only be examined if they are provided via e-mail: info@washandgolaundry.nl. 

14. Amendment of Privacy Policy.
Dabrel shall have the right to unilaterally amend the Privacy Policy partly or completely, in each case to the extent the amendments fully comply with applicable laws. The Buyer shall be informed of any changes to the policy through a link to the new version of the policy, which will be sent to the e-mail addresses that were indicated by the Buyers. The Buyer can object the changed policy by sending an email to: info@washandgolaundry.nl , which will then imply that the Buyer can no longer use the Wash&Go Laundry Solutions mobile application (if required by applicable law, the Buyer will, however, be asked needs to agree to any changes to the policy when signing into Wash&Go Laundry Solutions mobile application for the first time after the new version of the policy becomes valid).

15. Additions or amendments to the Privacy Policy shall take effect on the date of their publication, i.e. on the date they are uploaded into the mobile application.

16. You as data subject have a right to lodge a complaint with the competent supervising authority if you believe your personal data are or have not been processed in a way that is compliant with applicable law (e.g., the “Autoriteit Persoonsgegevens” in the Netherlands).

17. Right to data portability: you as data subject have the right to receive your personal data, which you have provided Dabrel, in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller without hindrance from Dabrel (where technically feasible, Dabrel will transmit your personal data directly to another controller upon your request)

18. Communication of a personal data breach: in case of a personal data breach, Dabrel shall notify the personal data breach to (i) the competent supervisory authority without undue delay and, where feasible, not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons and (ii) you, the data subject without undue delay if the personal data breach is likely to result in a high risk to the rights and freedoms of natural persons.
