Terms & Conditions for the purchase and sales of services in the Wash&Go Laundry Solutions mobile application

1. Definitions
1.1. Seller – Dabrel BV. Dabrel BV is a limited liability company registered under the laws of the Netherlands with registered number 63348918 and VAT number NL855197845B01 whose registered office is at Overhoeksparklaan 8, 1031KC Amsterdam, The Netherlands.
1.2. Wash&Go Laundry Solutions is a brand of and is represented by Dabrel BV.
1.3. Buyer – 1) all capable natural persons over 18 years of age; 2) minors up to eighteen years of age, who have the consent of parents, foster parents or guardians, except in cases when they dispose of their own earnings or scholarships (i.e., ontvoogde minderjarigen); 3) legal entities; 4) representatives authorized by the above mentioned persons or representatives of legal entities;
1.4. Parties – the Buyer and the Seller.
1.5. Personal Data – any information related to an identified or identifiable natural person – data subject. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
1.6. Rules – these "Terms and Conditions for the purchase and sale of services in the mobile application of Wash&Go Laundry Solutions".
1.7. Account – a result of the Buyer's registration in Wash&Go Laundry Solutions mobile application. An account is created in order to enable the Buyer to use the Wash&Go Laundry Solutions mobile application for the services rendered by the Seller by storing the Buyer's personal data and order history.
1.8. Electronic payment system - includes payments performed in Wash&Go Laundry Solutions mobile application.
1.9. Privacy Policy – a document approved by the Buyer, which contains the main rules for Personal Data collection, storage, and processing when using the Wash&Go Laundry Solutions mobile application.

2. General provisions
2.1. By confirming that he/she has read the Rules by checking the box next to the statement "I have read and approved the Terms and Conditions for the purchase and sale of services including the Privacy Policy in the mobile application of Wash&Go Laundry Solutions and agree to abide by them and agree that my Personal Data can be collected, stored and processed as set out in the Privacy Policy" the Buyer accepts that these Rules become binding between the Parties, determine the rights and obligations of the Buyer and the Seller, accepts the possible collection, storage and processing of his/her Personal Data as set out in the Privacy Policy, the terms and conditions for the purchase of services in view of the Wash&Go Laundry Solutions, payment procedures connected to the Wash&Go Laundry Solutions, liability and other conditions related to the purchase and sale of services via the Wash&Go Laundry Solutions mobile application.
2.2. Services of Wash&Go Laundry Solutions may only be purchased by Buyers if they have read and approved these Rules. By confirming and agreeing to the Rules and the Privacy Policy the Buyer confirms that he/she has the right to purchase services connected to the Wash&Go Laundry Solutions via the mobile application.
2.3. The Seller shall have the right to change, amend or supplement these Rules. The Buyer shall be informed of any changes to the Rules through a link to the new version of these Rules, which will be sent to the e-mail addresses that were indicated by the Buyers. The Buyer can object the changed Rules by sending an email to: info@washandgolaundry.nl , which will then imply that the Buyer can no longer use the Wash&Go Laundry Solutions mobile application (if required by applicable law, the Buyer will, however, be asked needs to agree to any changes to these Rules when signing into Wash&Go Laundry Solutions mobile application for the first time after the new version of the Rules becomes valid).
2.4. If the Seller has the right or obligation to provide information or documents to the Buyer via e-mail, then, in all cases, the Buyer shall be responsible of providing a valid e-mail address to the Seller and inform the Seller of any change in e-mail address.

3. Ordering of services in view of the Wash&Go Laundry Solutions, the moment of establishment of legal relations of purchase and sale
3.1. The Buyer can pay for the services connected to the Wash&Go Laundry Solutions by using Wash&Go Laundry Solutions mobile application
3.2. By ordering services connected to the Wash&Go Laundry Solutions using the mobile application, the Buyer must indicate his Personal Data in the information fields provided by the Seller because such data is necessary for the proper fulfillment of the order and to enable the Seller to provide its services.
3.3. When, after selecting the services connected to the Wash&Go Laundry Solutions, the Buyer carries out all the steps of the order, including the selection and confirmation of a payment method. The confirmation of the payment method and the payment itself shall be considered to establish legal relations of purchase and sale between the Buyer and the Seller, and result in a purchase/sale agreement between the Parties.
3.4. Each order of the Buyer through the mobile application shall be stored in the Wash&Go Laundry Solutions database operated by MKG Ltd. Eitminų 20-109, Vilnius LT-12145, Lithuania, a company of which Wash&Go Laundry Solutions licensed the software of the mobile application.

4. Rights of the Buyer
4.1. The Buyer shall have the right to purchase services connected to the Wash&Go Laundry Solutions via the mobile application according to the procedures established by these Rules.

5. Obligations of the Buyer
5.1. By using the mobile application, the Buyer must carry out his obligations, follow these Rules and the Privacy Policy, and not violate the legislation of, as applicable, the Netherlands or any other applicable legislation.
5.2. The Buyer must pay for the ordered services in connection to the Wash&Go Laundry Solutions, and accept them according to the procedures established by these Rules.

6. Rights of the Seller
6.1. The Seller shall have the right to unilaterally change, suspend or terminate the operation of certain functions of Wash&Go Laundry Solutions, or part of them.
6.2. The Seller shall have the unilateral right to suspend or terminate the operational activities of Wash&Go Laundry Solutions. In such a case, all accepted and confirmed orders of Buyers shall be fully carried out, and new orders will not be accepted.
6.3. The Seller shall have the right to unilaterally change the scope and method of services provided by Wash&Go Laundry Solutions, to suspend or terminate the provision of services or part of services provided by Wash&Go Laundry Solutions, to change the prices of those services and to charge for services or part of services provided by Wash&Go Laundry Solutions that were previously free of charge.
6.4. If the Buyer tries to negatively affect the operational stability and security of Wash&Go Laundry Solutions, or fails to carry out his obligations, then the Seller shall have the right to, immediately and without providing any prior notice, restrict or suspend the Buyer's possibility to use the mobile application or, in exceptional cases, delete the Buyer's Account. The Seller furthermore reserves all its rights to take further action in case of damages incurred by the Seller as a result of such negative affectation by the Buyer of the operational stability and security of Wash&Go Laundry Solutions, or any failure of the Buyer to comply with its obligations.

7. Obligations of the Seller
7.1. The Seller shall undertake to make it possible for the Buyer to use Wash&Go Laundry Solutions services according to the terms and conditions established in these Rules and other documents of Wash&Go Laundry Solutions.
7.2. The Seller shall undertake to provide the Buyer with clear and understandable information with regard to the Wash&Go Laundry Solutions.
7.3. The Seller shall undertake to respect the privacy of the Buyer and process the Buyer's Personal Data strictly according to the procedures established by these Rules, the Privacy Policy and the legislation of the applicable legislation.

8. Prices for services, payment terms and procedures
8.1. The Buyer may pay for the services connected to the Wash&Go Laundry Solutions by using Wash&Go Laundry Solutions mobile application.
8.2. When making the transaction, your credit card will be charged immediately for the transaction amount.

9. Quality assurance for services connected to the Wash&Go Laundry Solutions
9.1. The washing or drying cycle time of the Wash&Go Laundry Solutions may differ from the one indicated in the promotional or information material of Wash&Go Laundry Solutions, depending on the electricity and water supply specifics.
9.2. The quality of the services connected to the Wash&Go Laundry Solutions, offered by the Seller is appropriate, i.e. the features of those services match the description of the product. The services connected to the Wash&Go Laundry Solutions are considered to comply with the consumption purchase/sales agreement, if:
9.2.1. those services match the description provided by the Seller;
9.2.2. the services comply with the quality indicators that are normally associated with the same kind of services and that the Buyer may reasonably expect to receive according to the type of services.

10. Tardive Use
10.1. Buyer needs to use the ordered and paid services within 10 minutes after paying for it, in the absence of which the services can no longer be rendered and no refund shall apply.

11. Responsibility
11.1. The Buyer confirms that he/she has read the terms of use of Wash&Go Laundry Solutions provided on the machines and in the app and is fully responsible for his/her laundry (the Seller cannot be held liable for any theft of or damage to the Buyer’s laundry or other properties brought into the laundry location of Wash&Go Laundry Solutions), and will undertake full responsibility for any damages caused to the property of Dabrel BV, which resulted from failure to follow these Rules:
11.1.1. Laundry will not be properly washed and dried in overloaded washing machines, and may be damaged. The Seller indicates recommended loading limit on the machines, which is about 2/3 of the drum. If Buyer loads more laundry and damage occurs - Buyer is held responsible:
11.1.2. detergents must be placed directly into the tub together with the laundry;
11.1.3. only use the necessary detergent amount;
11.1.4. before placing the laundry in the washer or the dryer, make sure that the washer or the dryer is clean inside;
11.1.5. do not wash laundry that has been stained with oil or other chemicals;
11.1.6. remove (animal) hair from the laundry before washing;
11.1.7. make sure that all pockets of the laundry are empty;
11.1.8. do not dry bras with a metal underwire in the dryer;
11.1.9. make sure that the dryer filter is empty;
11.1.10. clean out the dryer filter after drying;
11.1.11. be present at the end of the cycle, so that you can collect your own laundry;
11.1.12. make sure that you have collected all your laundry;
11.1.13. Wash&Go Laundry Solutions shall not be responsible for any damaged or lost laundry or other property of the Buyer that is held or brought into the laundry location of Wash&Go Laundry Solutions. By using Wash&Go Laundry Solutions, the Buyer is completely responsible for the condition of his/her laundry by choosing the cycle and laundry to wash/dry.
11.1.14. Wash&Go Laundry Solutions is not responsible for cleaning of the laundry location and the machines installed within the location.
11.2. The Buyer shall be responsible for his actions carried out in Wash&Go Laundry Solutions locations and when using the mobile application.
11.3. After registering, the Buyer shall be responsible for the storage and/or transfer of his login data to third parties. However, the Seller has the right to receive the Personal Data concerning him or her, which he or she has provided to the Buyer, in a structured, commonly used and machine-readable format and has the right to transmit those data to another controller without hindrance from the Buyer, if and to the extent provided and allowed under applicable law. If Wash&Go Laundry Solutions is used by a third party who logged in to Wash&Go Laundry Solutions mobile application system by the using the Buyer’s login data, then the seller shall consider this person to be the buyer.

12. Exchange of information
12.1. The Seller shall submit all notifications it deems necessary (if and to the extent allowed under applicable law) to the e-mail address or via SMS to the phone number indicated by the Buyer during registration or when ordering products.
12.2. The Buyer shall submit all his messages and questions to the Seller via contact in the app or per e-mail to: info@washandgolaundry.nl.

13. Refund policy of money
13.1 To be able to buy any of the services provided by Wash&Go Laundry Solutions via the mobile application, the Buyer needs to upload the amount of 15 Euros or 25 Euros via the payment methods displayed in the mobile application.To receive a refund of credit of any credit left, the Buyer must send a screenshot of its mobile application account and its bank account number to: info@washandgolaundry.nl ; Refunds will incur an administration charge of 3.00 Euros that will be deducted directly from the refund value. Refunds will be made on the bank account number provided by the Buyer. Note that only bank accounts in the EU can be used for refunding. Refunds will not be processed for any free credit. Any unused credit will expire 12 months after the date of purchase.
13.2 In case of a technical failure, we will refund the amount of money spent on the specific wash or dry after checking the specific machine. The Buyer need to send a message about the potential malfunctioning of the machine within 48 hours via contact in the app or via e-mail: info@washandgolaundry.nl ; Please note that we only reimburse via de app. In case you do not have an account on the app (because you paid with coins) you need to create an account on the app to be able to receive the reimbursement.

14. Final provisions
14.1. These Rules shall be governed by the laws of the country where the services are provided.
14.2. All disputes arising from the execution and/or termination or changes of these Rules shall be settled by the competent courts of the place where the services are provided.
